What is a Trademark?
A trademark is what is known as a "source identifier." It helps consumers distinguish your products from those of your competitors. It may be the name of your company, like Nestle® ; the name of your product, like iPhone®; or a graphic design, like the Nike® "swoosh" logo. Do I have to register my trademark? No. Using your mark in commerce will allow it to gain "common law" rights. But, these rights are much more limited in scope than the nationwide protection offered by a federally registered trademark.
